3-03-07 Smith and and his Attorneys still trying to steal settlement
funds paid to settle tax litigation years ago.
Smith, after signing a settlement agreement making the Aardvark Partnerships
the exclusive beneficiary of the settlement agreement and each side agreeing to pay their
own attorney fees and costs, now is attempting to foreclose on trust deeds on
Sandra Kardos' properties and personally keep the funds along with his attorneys
and giving the Aardvark Partnerships nothing.
Here is the lawsuit we just filed to return the properties
On 11-20-98 we reached an agreement with Peter Smith and his attorneys Baker,
Silverberg, et al. All parities agreed that no one admitted to any wrongdoing . All parties
and their representatives were released except Fred Rucker, who had represented all
parties (on both sides of this case at various times), and he was specifically excluded from
releases by all the parties.
More data will be posted as it is signed, transcribed, scanned and entered. The
agreement will ultimately eliminate any possible liability to the general partners. While
a number of the partners were not reachable as letters sent to them were not deliverable,
99%+ of those responding agreed to our request and signed the agreement
transferring their partnership interests to Charles Brink. He, as both the general Partner and
as the attorney-in-fact for the Aardvark Partnerships, will close the partnerships. More
on the mechanics will be posted here later.

Rucker) to Charles Brink and Sandra Kardos and to you as a partner in one of the
fraudulent Government Securities partnerships.
We are posting on this web site a number of documents to provide background information

Are you requesting money?. We are not asking for any more money for
our services. The amount contributed in 1987, along with the funds recovered from the
promoters, is all we asked originally for that work. If anyone wants to send contributions
to our cost of defense, that would be welcome. But, just your signature on the the
agreement his very much appreciated.
10-1-98 Was I a general Partner? Yes, to receive losses in excess of
your "investment" (basis) you needed to be at risk for those losses (IRC 465).
As a general partner you were at risk. The partnership
agreement required the majority vote, by ownership, of the partners to act.
In September 1998 we sent a letter to each of the individuals who joined our litigation
fund against Tax and Financial Programming (TFP) in 1986-87.
We sent with that letter an agreement for each person in the group to sign to help us and you get
out of this problem forever.
This is a transcript of a CBS News "60 Minutes" Show on the Alliance fraud
which aired on 5-21-89. Fred Rucker was a member of the Stites law firm. Most were
indicted and prosecuted. Fred Rucker testified as to his improper activities under a grant
of immunity in this criminal case.
